1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Wynko, currently operated as an unregistered venture by Mahipat Singh Sengar of 154 Sevagram Colony, Khajuraho, Madhya Pradesh, India ("Wynko", "we", "us"). They govern your use of https://wynko.in and our applications (the "Platform").

By creating an account or using the Platform, you accept these Terms and our Privacy Policy. If you don't accept them, don't use the Platform.

2. Who can use Wynko

The minimum age is 13.
If you are under 18, you may use Wynko only with the consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Platform. We may ask for verifiable parental consent before activating your account, as required by India's DPDP Act, 2023.
You must not use Wynko if we have previously banned you, or if the law where you live prohibits it.

3. Your account

Give accurate information and keep it current.
You are responsible for all activity under your account and for keeping your Google Sign-In and account access secure. Tell us at founder@wynko.in immediately if you suspect unauthorised access.
One person, one account. Don't share, sell, or transfer it.
We may reclaim or change usernames that are misleading, infringing, impersonating, or offensive.

4. What Wynko provides

Wynko offers study and collaboration tools, including solo focus sessions and timers, goal and streak tracking, study chat rooms, live voice rooms, groups, and leaderboards. We may add, change, or remove features as the product develops.

Wynko is a study tool, not an educational institution. We do not award qualifications, we do not guarantee any exam result or academic outcome, and nothing on the Platform is professional, medical, financial, or career advice.

5. Acceptable use

You agree not to:

Post or send anything unlawful, harassing, hateful, sexually explicit, violent, or that bullies, grooms, or endangers another user — we take this especially seriously because many of our users are minors;
Impersonate anyone or misrepresent your identity, age, school, or credentials;
Share copyrighted material you don't have the right to share — textbooks, paid course material, leaked question papers;
Use Wynko to cheat, or to help others cheat, in any exam or assessment where that is prohibited;
Spam, advertise, or solicit other users, including coaching-class or referral promotion, without our written permission;
Scrape or harvest data, use bots or scripts to inflate study time, streaks, or leaderboard rank, or otherwise manipulate metrics;
Probe, breach, or bypass our security or rate limits, upload malware, or disrupt the Platform;
Reverse engineer, decompile, or copy the Platform, except where the law says such a restriction cannot apply;
Resell, sublicense, or commercially exploit the Platform without our written permission;
Break any applicable law or infringe anyone's rights.

We may investigate violations, remove content, restrict features, or ban accounts, and we will cooperate with law enforcement where appropriate.

6. Chat rooms, voice rooms, and shared spaces

Anything you post in a study room or group is visible to the other members of that space, and they may see, quote, or screenshot it. Don't share personal contact details, addresses, or anything private.
Voice rooms are live. When you unmute, everyone in the room hears you. Your audio is streamed through our provider Agora and is not recorded by us.
Do not record, stream, or share other people's voice or messages from a room without their clear permission. Recording someone without consent may break privacy and criminal law, and will get your account banned.
Keep voice rooms study-appropriate. Abusive, sexual, threatening, or harassing speech is a violation of these Terms, and we treat anything targeting a minor as a priority safety issue.
Room creators and moderators may remove members or messages in their space. We may remove any room or content that breaks these Terms.
Report abuse, harassment, or anything involving a minor's safety to founder@wynko.in. We prioritise these reports. Because voice is not recorded, report incidents as soon as they happen and include the room, time, and usernames involved.
We are not responsible for what other users post, but we will act on valid reports.

7. Your content

You own the notes, files, messages, and other content you create ("Your Content").
You grant Wynko a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, and distribute Your Content only to operate, secure, and improve the Platform and to show it to the users you share it with. This licence ends when you delete Your Content or your account, except for backup copies and anything we must keep by law.
You confirm you have the rights to share Your Content and that it doesn't break these Terms.
We don't routinely monitor content, but we may remove anything we reasonably believe violates these Terms or the law.
If you send us feedback or ideas, we may use them freely without owing you anything.

8. Our intellectual property

The Wynko name, logo, software, design, and content belong to us or our licensors and are protected by copyright and trademark law. We grant you a limited, personal, non-transferable, revocable licence to use the Platform for your own learning. Nothing else is granted.

9. Copyright complaints

If you believe content on Wynko infringes your copyright, email founder@wynko.in with your contact details, identification of the work, where the content is on Wynko, and a statement that you believe the use is unauthorised. We will review it, remove infringing material where appropriate, and may ban repeat infringers.

10. Paid plans (planned)

Wynko is free today. We plan to introduce paid plans, and when we do:

Prices, features, and billing periods will be shown clearly at checkout, with taxes stated.
Subscriptions will renew automatically unless cancelled before the renewal date. You'll be able to cancel any time by emailing founder@wynko.in, effective at the end of the current period.
Payments will be processed by Razorpay. We will never store your card or bank details.
Refunds: you can request a full refund within 7 days of your first purchase of a plan. Renewals are non-refundable. Your statutory consumer rights are unaffected.
We'll give at least 30 days' notice before a price change applies to your renewal.
Any study time, streaks, points, or virtual rewards have no cash value and cannot be exchanged for money.

11. Beta features

Features marked "beta" or "early access" are provided as-is, may be unstable, and may change or disappear at any time.

12. Third-party services

Wynko relies on and links to third-party services, including Google Sign-In, Supabase, Backblaze, Cloudflare, Vercel, Agora (voice), and Google Analytics. We're not responsible for those services, and your use of them is governed by their own terms and privacy policies.

13. Availability

We aim to keep Wynko running, but we don't promise uninterrupted service. We may suspend the Platform for maintenance, upgrades, or emergencies, and we may change or discontinue features. Voice rooms depend on your network and on Agora, so call quality, drops, and outages are outside our control. Since Wynko is early-stage, outages and data-affecting bugs are possible — please keep your own copies of anything important.

14. Suspension and termination

You can stop using Wynko and delete your account at any time by emailing founder@wynko.in from your registered email address.
We may suspend or terminate your access — with notice where reasonably possible — if you break these Terms, if your use puts other users or us at risk, or if we discontinue the Platform.
On termination your licence to use the Platform ends. Sections 7 (backups), 8, 15, 16, 17, and 19 survive.
If we shut Wynko down entirely, we'll give reasonable notice and a way to export your content.

15. Disclaimers

To the maximum extent permitted by law, the Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We don't warrant that the Platform will be error-free or secure, or that any content on it is accurate or complete — always check important study material against your official syllabus or teacher.

16. Limitation of liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost study time, or lost opportunities including exam results, even if we were warned they were possible.
Our total liability arising out of or relating to these Terms or the Platform is limited to the greater of (a) what you paid us in the 12 months before the claim, or (b) INR 5,000.

Nothing here excludes liability that cannot be excluded by law, including for fraud, death, or personal injury caused by negligence, or your rights under the Consumer Protection Act, 2019.

17. Indemnity

You agree to cover Wynko and its founders against claims, damages, losses, and reasonable legal costs arising from Your Content, your use of the Platform, or your breach of these Terms, of the law, or of anyone's rights.

18. Changes to these Terms

We may update these Terms. For material changes we'll give at least 7 days' notice by email or in-app. Continuing to use Wynko after that means you accept the updated Terms; if you don't, stop using the Platform and delete your account.

19. Governing law and disputes

These Terms are governed by the laws of India. The courts at Chhatarpur (Khajuraho), Madhya Pradesh have exclusive jurisdiction, except that consumers may bring claims where mandatory local law allows.

Before starting formal proceedings, please email founder@wynko.in so we can try to resolve the issue informally within 30 days.

20. General

Entire agreement: these Terms and the Privacy Policy are the complete agreement between us.
Severability: if a clause is unenforceable, the rest still applies.
No waiver: not enforcing a right doesn't waive it.
Assignment: you can't assign these Terms. We may assign them — for example when Wynko is incorporated as a company, or in an acquisition.
Force majeure: we're not liable for failures beyond our reasonable control.
